询盘是指交易的一方欲购买或出售某种商品,向另一方发出的探寻买卖该商品及有关交易条件的一种表2113示。这种表示可用口头或书面形式表达,通常多由买方发出。卖方没有5261必须回答的义务。在磋商交易中,尽管询盘本身不具备法律约束力,但却是联系客户的一种方法,而且也是我们调查研究、探求市场4102动态的重要手段。分为一般询盘和具体询盘。实盘(firm offers)则规定有效日期,而且卖盘一旦被接受,报盘人就不能撤回。报盘(offer),也叫报价,是卖方主动向买方提供商品信息,或者是对询盘的答复,1653是卖方根据卖方的来信,向买方报盘,其内容可包括商品名称、规格、数量、包装条件、价格、付款方式和交货期限等。还盘(counter-offer),也叫还价,是贸易往来中(内主要是对价格)的磋商(negotiation)过程。 当买、卖双方,不能接受对方所提供的某项贸易条件时,可以通过还盘说明原因,表示遗憾,或建议对方给予一定容让步。
